1. Acceptance of terms & eligibility
By creating an account or otherwise using the ProBer Client or ProBer Provider app, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old to create an account. By registering, you confirm that you are 18 or older and that all information you provide — your name, email, phone number, and, for providers, your identity and qualification documents — is accurate, current, and complete. You agree to keep this information up to date.
2. Description of service
ProBer operates a marketplace that connects clients who need a service performed with independent professionals who offer to perform it. ProBer is not a staffing agency and does not employ providers. Providers who accept jobs through ProBer are independent contractors, not employees, partners, or agents of ProBer. ProBer does not control the manner, means, or hours in which a provider performs a job, and is not responsible for the quality, safety, or legality of the services a provider performs, except as expressly stated in these Terms.
3. Account responsibilities
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You must notify us promptly of any unauthorized use of your account.
- Each person may hold only one client account and, if applicable, one provider account. Creating duplicate accounts to evade a suspension, rating, or verification decision is a violation of these Terms.
- You may not use the Services if we have previously suspended or removed you for a violation of these Terms.
4. Terms for clients
Booking
To request a service, you choose a category, describe the job, and provide a location and, where applicable, a preferred time. ProBer matches your request to an available, qualified provider in that category.
Pricing
Pricing depends on the category: some categories use a tier-based estimate based on the scope of work, while others use a fixed menu price for the specific service you select. In both cases, a service fee is added at checkout, and the full total — including the service fee — is shown to you before you confirm the booking. Prices are set and disclosed at the time of booking and are subject to change for future requests.
Payment authorization
When you confirm a booking, you authorize ProBer, through our payment processor Stripe, to charge your selected payment method for the total shown. Funds are captured in connection with the booking and confirmation of the completed job, as described at checkout.
Cancellation
You may cancel a request free of charge before a provider begins the job. Once a provider has begun work, cancellation may no longer be eligible for a full refund; contact Support for help with a specific booking, and we will review the situation and process a refund through Stripe where appropriate.
5. Terms for providers
Verification
Before you can accept jobs, you must complete our verification process for your category, which may include submitting a government-issued ID, proof of professional insurance, and relevant certifications or licenses, and may include a scored review of your experience, portfolio, and references. ProBer reserves sole discretion to approve, reject, or request additional information during verification.
Tiers
Verified providers are placed into a tier based on their verification score. Your tier can affect which jobs you are matched with and the base pricing shown to clients for your category. Tiers may be reassessed periodically or upon request.
Payouts
Payouts are made through Stripe Connect to the bank account or debit card you connect during onboarding. ProBer deducts a platform service fee from each job's price before paying out the remainder to you; the fee is disclosed in your account settings and may be updated from time to time with notice. Payout timing is described in-app and may vary based on your bank and Stripe's processing times.
Independent contractor status & taxes
As an independent contractor, you are solely responsible for determining and paying any taxes owed on income earned through ProBer, including income tax and any applicable self-employment tax, in accordance with the laws of the State of Illinois and any other jurisdiction that applies to you. ProBer does not withhold taxes on your behalf and does not provide tax, legal, or financial advice. Where required by law, ProBer or Stripe may issue you applicable tax reporting documents based on your payout history.
6. Reviews & ratings
Ratings and written reviews must reflect your genuine experience with a specific job. You may not offer, solicit, or accept anything of value in exchange for a review, submit reviews for jobs you were not party to, or otherwise attempt to manipulate ratings. ProBer may remove reviews that are abusive, harassing, off-topic, or that we reasonably believe were submitted in violation of this section, and may adjust or remove a provider's aggregate rating when reviews are removed.
7. Prohibited conduct
You agree not to:
- Provide false, misleading, or fraudulent information, including during identity or payment verification;
- Harass, threaten, or discriminate against another user;
- Attempt to circumvent the platform to arrange payment for a matched job outside of ProBer, in order to avoid the service fee;
- Post fake, manipulated, or incentivized reviews;
- Use the Services for any unlawful purpose, or in a way that violates any applicable law or regulation;
- Interfere with, reverse-engineer, or attempt to gain unauthorized access to the Services or other users' accounts.
8. Liability & dispute resolution
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROBER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES, OR FOR THE ACTS OR OMISSIONS OF ANY PROVIDER OR CLIENT, WHO ACT INDEPENDENTLY OF PROBER. Because providers are independent contractors and not ProBer employees, ProBer is not liable for the quality, timeliness, or outcome of the work a provider performs, though we take reports of misconduct seriously and may suspend a provider pending investigation.
If you have a dispute with ProBer, we encourage you to contact Support first so we can try to resolve it directly. Any dispute that cannot be resolved informally will be governed by the process and jurisdiction described in Section 10 below.
9. Termination
You may stop using the Services and request deletion of your account at any time, as described in our Privacy Policy. We may suspend or terminate your access to the Services, at our discretion, if we believe you have violated these Terms, provided false information, posed a risk to other users, or engaged in fraudulent or abusive conduct. Where reasonably possible, we will notify you of the reason for suspension or termination.
10. Changes, governing law & contact
We may update these Terms from time to time. If we make material changes, we will notify you in-app or by email before they take effect; continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles.
